Introduction

Learning Outcomes:-

2. Distinguish between different forms of IP including Trademark, Patent, Copyright, Design, GI, and Trade Secret.
3. Analyze the legal distinction between idea and expression in copyright jurisprudence.

5. Distinguish trademark infringement from the common law remedy of passing off.
6. Interpret the statutory framework of the Trade Marks Act, Patents Act, Copyright Act, and Designs Act.
7. Understand the institutional structure and powers of the Controller General of Patents, Designs & Trade Marks.
8. Identify jurisdictional roles of the Trademark Registry, Patent Office, Commercial Courts, and High Courts.
9. Explain core IP concepts including infringement, prior art, distinctiveness, and well-known marks.
10. Analyze the doctrine of compulsory licensing and fair use under IP laws.
11. Understand procedural stages in the IP lifecycle from application to registration.
12. Examine the examination and opposition mechanisms in IP registration processes.
13. Evaluate enforcement remedies available in cases of infringement.
14. Interpret rectification proceedings and cancellation mechanisms.
15. Develop foundational clarity to assess protection strategies across the IP lifecycle.
